TERMS OF USE (CUSTOM EULA)

This Terms of Use (“Agreement”) governs your use of the LivingLife Personal Shopping mobile application (“App”) and related digital services (“Services”). This Agreement supplements and incorporates Apple’s Standard Licensed Application End User License Agreement (Standard Apple EULA). Where a conflict exists, this Custom EULA controls.

By using the App or Services, you agree to be bound by this Agreement.

1. License

You are granted a limited, non-exclusive, non-transferable license to use the App on Apple-branded devices you own or control, consistent with the Apple Standard EULA.

2. Eligibility

You must be 18 years of age or older to use the App.
Accounts created by minors will be removed.

​

3. User Accounts

You agree to:

Provide accurate information

Maintain confidentiality of your login credentials

Use the App only for lawful purposes

We may suspend or terminate accounts for violations of these Terms.

​

4. Identity Verification

Identity verification may be required for Stylists and is optional for Clients.
Verification may involve submitting a selfie and ID image to our verification provider.

LivingLife Personal Shopping does not store:

ID photographs

Biometrics

Facial geometry

Face templates

We receive only a verification result.

​

5. Payments, Subscriptions & Payouts

Payments and auto-renewable subscriptions are processed through secure third-party providers.
Stylists receive payouts through authorized fintech partners.

LivingLife does not store financial account numbers.
Fees are non-refundable except where required by law.

6. User Conduct

Users may not:

Harass, abuse, or harm others

Upload unlawful or infringing content

Impersonate others

Interfere with the App

Engage in fraud, payment abuse, or false identity verification

We may suspend or remove content or accounts.

7. User Content

Users retain ownership of all content they upload.
By uploading content, you grant LivingLife a limited license to:

Store

Display

Process

…solely to operate the platform.

​

8. Intellectual Property

All trademarks, logos, and software are owned by LivingLife or its licensors.
You may not reverse-engineer, copy, or modify the App.

​

9. Limitation of Liability

To the maximum extent permitted by law, LivingLife is not liable for:

Indirect, incidental, or consequential damages

Loss of data

Personal injury

Disputes between Users

In-person styling interactions

Maximum liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Disclaimers

The App is provided “as is” without warranties of any kind.
We do not guarantee:

Outcomes of styling advice

Stylist availability

Accuracy of recommendations

Error-free operation

11. Indemnification

You agree to indemnify LivingLife for claims arising out of:

Your use of the App

Your content

Your violation of these Terms

​

12. Governing Law

This Agreement is governed by the laws of the State of New York, without regard to conflict-of-law principles.
Disputes must be resolved by arbitration or courts located in New York County.

​

13. Updates

We may update this Agreement. Continued use of the App constitutes acceptance.
